CS gas used to restrain man

A man who was only restrained after police used CS gas was given a community payback order when he was sentenced at Stranraer Sheriff Court on Tuesday.

Thirty-six-year-old Stuart Macdonald, of 10 Archyswell Lane, Stranraer, pled guilty to resisting arrest, refusing to be handcuffed, trying to escape and lashing out at two police officers, resulting in them having to deploy CS gas on December 18 at his home address.

In mitigation, the accused’s lawyer, Michael Kilkerr, said that both Macdonald and his wife had been out that night drinking and there was a row after confusion about who arrived home first.

The accused’s wife phoned the police to report a domestic incident and the police duly arrived at the door. Mr Kilkerr said that Macdonald’s reaction had been “totally inappropriate”.

Sheriff Kenneth Robb ordered the accused to complete 70 hours of unpaid work, saying that the police had a difficult job to do and Macdonald had his judgement clouded that night by drinking to much.
