The council has initiated court proceedings against Kier Construction Ltd in relation to DG One leisure complex in Dumfries.
The Council is seeking to recover the costs of the necessary repair work which is needed to bring the complex up to the contractual standard. The Council is also seeking to be reimbursed for certain associated costs as well as its legal costs. The council will be seeking the sum of £5,118,100 from Kier Construction Ltd to address various issues.
Council Leader Ivor Hyslop said:
“The council has for some time been in correspondence with the contractor which designed and built the complex, Kier Construction Ltd, in an attempt to resolve matters without the necessity of court proceedings being raised. However, the council considers that Kier’s response has been inadequate and in these circumstances it is appropriate to raise court proceedings. DG One is the region’s flagship leisure complex and it needs to be fully operational.”
The council is now making arrangements to undertake the necessary works and will update the public on proposals to close the complex and on the alternative arrangements for leisure and sport provision in Dumfries during the proposed closure period.
